Legal fees can vary depending on the type and complexity of your case. Generally, there are two types of fees: court fees and legal (litigation) fees.
Court fees are structured as follows:
- As per the latest legal amendments in the State of Kuwait, the court filing fees are now determined on a progressive tiered basis relative to the claim amount, as outlined below:
5% of the claim amount up to 30,000 KWD
3.5% of the claim amount exceeding 30,000 KWD and up to 150,000 KWD
2.5% of the claim amount exceeding 150,000 KWD and up to 500,000 KWD
1.5% of the claim amount exceeding 500,000 KWD and up to 5,000,000 KWD
1% of the claim amount exceeding 5,000,000 KWD
The total court fee is the cumulative sum of each applicable tier - Additional fees may apply, such as expert fees if the court assigns one
- A 100 KWD stamp fee is required for some cases
- Appeal Court fee is 50 KWD, and the Supreme Court fee is 500 KWD
These fees are paid directly to the court.
In labor cases, court fees are not required unless the plaintiff loses the case, Then an expert fee might apply.
As for litigation fees, these are separate from court fees and are based on a mutual agreement between the client and the lawyer, depending on the scope and nature of the legal work involved.
